The attorney general was fined £5,000 this week for employing an illegal immigrant as her housekeeper.
The UK Border Agency (UKBA) declared the law-maker had not knowingly broken the law but criticised for her failure to keep a copy of documents provided by her housekeeper.
The Conservatives and the Liberal Democrats have both called for the attorney general to step down following her fine.
And Mr Hesford said he has now resigned, claiming he can no longer support her.
Baroness Scotland, however, has refused to stand down after receiving support from Gordon Brown.
In a letter to the prime minister, Mr Hesford said: 'My decision comes about because as an aide to the Law Officers, whilst I have great personal regard for the attorney general, I cannot support the decision which allows her to remain in office.
'In my view the facts of the case do not matter. It is the principle which counts, particularly at a time when the publics' trust of Whitehall is uncertain to say the least.
'We have to be seen to be accountable.'
