Briatore was slapped with an indefinite suspension at the FIAs World Motor Sport Could hearing into the 2008 Singapore grand prix race-fixing scandal, where former Renault driver Nelson Piquet was asked to deliberately crash out of the race to assist his team-mate Fernando Alonso. The Spaniard went on to win the race.
At a preliminary hearing at the Tribunal de Grande Instance in Paris on Monday, the court considered Briatores application against the governing body and decided his case was worthy of a hearing.
The hearing will take place on November 24th, where Briatore will attempt to get his ban overturned by French courts and seek damages from the FIA.
